How Inn-Flow Complies with California Overtime Laws

This article explains how the Inn-Flow Labor and Payroll supports California-specific overtime rules, including daily overtime, daily double time, and 7th consecutive day requirements. These rules differ substantially from federal FLSA rules and must be followed precisely to maintain compliance.

Overview


California overtime requirements go beyond the federal 40‑hour weekly overtime rule. Employers must apply daily overtime, daily double time, and 7th consecutive day rules—always ensuring employees receive the most favorable pay outcome.


Inn-Flow supports these requirements through a state‑specific OT engine that can be toggled on at the enterprise level.


California Overtime Rules


1. Daily Overtime (OT)

  1. More than 8 hours in a single workday is paid at 1.5× the regular rate.
  2. Applies regardless of weekly total hours.


2. Daily Double Time (DT)

  1. More than 12 hours in a single workday is paid at the regular rate.


3. Weekly Overtime

  1. More than 40 hours in a workweek is paid at 1.5× the regular rate.
  2. Weekly OT is not added on top of daily OT; employees receive whichever outcome pays more.


4. 7th Consecutive Day Rules


            If an employee works 7 consecutive days in the employer‑defined workweek:

  1. First 8 hours on the 7th day are paid at 1.5×
  2. Hours above 8 on the 7th day are paid at


Note: If the 7th consecutive day falls into a new workweek, the rule does not apply.


5. Excluded Hours


The following do not count toward daily or weekly overtime:

  1. PTO
  2. Paid holidays
  3. Paid leave categories that do not qualify as “hours worked” under California law

Blended / Weighted Average Rate (California)


When employees work multiple rates in a workweek, a weighted average rate is required.

Blended Regular Rate = Total Straight‑Time Earnings ÷ Total Hours Worked


Overtime multipliers apply as follows:

  1. 1.5× for daily OT, weekly OT, or 7th‑day OT
  2. for daily double time or 7th‑day double time


California requires that the system pay employees whichever rate produces the higher pay outcome:

  1. Blended rate × multiplier, or
  2. Rate‑in‑effect (the rate being worked at the time OT/DT is triggered)


Inn‑Flow automatically selects the higher value.

Weekly Overtime (California)


Weekly OT applies only to regular hours beyond 40.

  1. Paid at Blended Rate × 1.5
  2. SPOT and DOT hours never contribute toward the 40‑hour threshold

  1. Regular = 39 → below 40
  2. SPOT/DOT paid per day‑level rules
  3. No weekly OT


Summary

  1. Inn‑Flow always pays the most favorable outcome to the employee
  2. Calculations use the local hotel time zone
  3. Daily boundaries follow the employer’s configured workday start
  4. Weekly boundaries follow the entity‑defined workweek start


These rules ensure full compliance with California’s Labor Code and wage order requirements.
